Justices Odili, Ejembi Eko and Tijjani Abubakar, who dissented in their judgment, held that Buni, as an executive governor of a state, cannot act in the capacity of acting chairman of the APC.

They also held that the Yobe State governor acted in violation of Section 183 of the 1999 Constitution of the Federal Republic of Nigeria as amended.

How ever in the   Majority Judgment the Apex Court upheld  that it is not in dispute that Governor  of Yobe  State  Mai Mala Buni as the  National  Chairman of   APC Caretaker Committee is in breach of section 183 of the constitution
The Court observed that  Governor who was alleged to have breached the constitution ought to have been made a party in the petition to answer to the allegations.
